Our company and its affiliates make substantial commercial real estate loans. We had a borrower default on a $46,000,000+ lending situation secured by 4 Phoenix area apartment complexes with a total of 748 units. The complexes were in the middle of extensive renovations at the time of default. Because of the misapplication of CAPX monies for other purposes, a multitude of construction claimants had obtained judgments against the borrower and were invading the rental income from the property. Howard Meyers stopped both the defaulting borrower and the construction judgment creditors in their tracks by securing (a) the appointment of a receiver on our behalf to enforce the assignment of rents; and (b) an injunction which barred the construction judgment creditors from interfering with the rental stream. By means of the receivership, our company was able to stabilize the projects, complete the renovations without further incident and achieve a constructive realization upon our collateral security. Throughout this entire process, Howard Meyers gave us great advice, timely service and helped us achieve our business goal of maximum recovery on a cost effective basis.
